These Terms of Service ("Terms") govern your access to and use of the QuikClaims website, the early-access program, and the QuikClaims application and services (collectively, the "Service"), operated by AnswerPoint Medical Systems, a division of The AnswerPoint LLC ("AnswerPoint," "we," "us," or "our"). By accessing the Service or submitting a request for early access, you agree to these Terms. If you do not agree, do not use the Service.
QuikClaims is a claims clearinghouse and claim-management platform for healthcare practices. During the early-access period, portions of the Service may be unavailable, offered on a limited or trial basis, or changed or discontinued at any time without notice. Submitting an early-access request does not create an account or guarantee that a trial or the Service will be made available to you.
You must be at least 18 years old and authorized to act on behalf of the practice or organization you represent. The Service is intended for use by healthcare providers and their staff, not for use by patients or the general public.
If and when an account is made available to you, you are responsible for the accuracy of the information you provide, for maintaining the confidentiality of your credentials, and for all activity under your account. Notify us promptly of any unauthorized use.
Any use of the Service that involves protected health information (PHI) as defined by HIPAA is governed by a separate Business Associate Agreement (BAA) between your organization and AnswerPoint. Do not submit PHI through the early-access request form or any other channel not covered by a signed BAA.
The Service, including its software, content, and trademarks, is owned by AnswerPoint or its licensors and is protected by law. These Terms do not grant you any right to our intellectual property except the limited right to use the Service as permitted here.
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that claims processed through it will be accepted or paid by any payer.
To the fullest extent permitted by law, AnswerPoint will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising from or related to your use of the Service.
We may update these Terms from time to time. Material changes will be reflected by updating the effective date above. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the State of Ohio, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in Ohio.
